An Act to amend the Act respecting administrative justice and other legislative provisions

On April 26, Bill 103 entitled An Act to amend the Act respecting administrative justice and other legislative provisions was introduced in the National Assembly. The Bill proposes that the members of the Tribunal administratif du Québec be appointed to hold office during good behaviour, introduces new rules concerning judicial ethics and amends certain rules of procedure applicable before the Administrative Tribunal.

In matters of compensation and benefits, the Bill, if enacted, will establish a new proceeding before the Tribunal that makes it possible to contest a decision for which an application for an administrative review has been submitted and that has not been reviewed upon expiry of the time limit. The Bill also provides that the Tribunal is to offer conciliation upon receipt of a case record in this type of matter.
