Transparency and Ethics in lobbying
The Lobbying Transparency and Ethics Act aims at making the lobbying of public office holders transparent and ensuring that lobbying activities are properly conducted.
The Act defines lobbying activities and establishes three categories of lobbyists: the consultant lobbyist, the enterprise lobbyist and the organization lobbyist.
The Act provides for the mandatory entry and updating of certain information on lobbyists and their activities in a public registry, in particular as concerns the object of the lobbying activities. The responsibility for maintaining the registry of lobbyists is assigned by the Act to a registrar.
The Act also creates a Commissaire au lobbyisme whose duties are to monitor and control lobbying activities. Appointed by the National Assembly, the Commissaire au lobbyisme is also responsible for developing a code of conduct, initiating studies and inquiring into violations of the Act or code of conduct.
The Lobbying Transparency and Ethics Act prohibits certain lobbying practices and provides for disciplinary measures and penalties for any breach of the legislation or code of conduct.
