Notice of judicial selection - Candidates for the office of judge of the Court of Québec and judge of a municipal court

Pursuant to section 7 of the Regulation respecting the selection procedure of candidates for the office of judge of the Court of Québec, municipal court judge and presiding justice of the peace (Order in Council 14-2012 dated 11 January 2012 PDF document), the Minister of Justice invites interested persons to submit their applications for the following positions:

COURT OF QUÉBEC

CQ-2012-001: One position as a judge sitting in the Youth Division with residence in Saint-Jérôme or the immediate vicinity. The person selected will be required to sit in the judicial districts of Labelle, Laval, Joliette and Terrebonne.

CQ-2012-002: One position as a judge sitting in the Criminal and Penal Division and also in the Civil Division with residence in Granby or the immediate vicinity. The person selected will be required to sit in the judicial districts of Saint-François, Mégantic, Bedford and Drummond.

CQ-2012-003: One position as a judge sitting in the Civil Division with residence in Montréal or the immediate vicinity.

CQ-2012-004: One position as a judge sitting in the Civil Division with residence in Sherbrooke or the immediate vicinity. The person selected will be required to sit in the judicial districts of Saint-François, Mégantic, Bedford and Drummond.

CQ-2012-005: One position as a judge sitting in the Criminal and Penal Division with residence in Québec or the immediate vicinity. The person selected will be required to sit in the judicial districts of Québec, Beauce, Charlevoix, Frontenac and Montmagny.

CQ-2012-006: One position as a judge sitting in the Civil Division, in the Criminal and Penal Division and also in the Youth Division with residence in New Carlisle or the immediate vicinity. The person selected will be required to sit in the judicial districts of Rimouski, Gaspé, Bonaventure, Baie-Comeau, Mingan and Kamouraska.

MUNICIPAL COURT

CM-2012-001: Three positions as a judge sitting in the Municipal Court, Ville de Montréal. The persons selected will sit in both criminal and penal cases and will be required to sit in the evening.

For all the above positions at the Court of Québec and the municipal court, knowledge of English is required.

LEGAL CONDITIONS OF ELIGIBILITY

This notice is addressed to persons on the Roll of the Order of Advocates who have practised their profession for at least 10 years. Applications for a position as a judge and all attached documents will be held in strict confidence.

APPLICATION PROCEDURE

Candidates must apply in writing by sending to the secretariat the form shown in Schedule A of the Regulation, duly completed, a recent photograph, and proof of entry on the Roll of the Order of Advocates (a photocopy of the card showing membership of the Barreau du Québec is accepted). Six copies of all documents must be provided.

A candidate who is a municipal judge wishing to apply for another position as a municipal judge must send, to the associate chief judge of the Court of Québec responsible for municipal courts, the form shown in Schedule A of the Regulation, duly completed, a recent photograph, and proof of entry on the Roll of the Order of Advocates (a photocopy of the card showing membership of the Barreau du Québec is accepted). Two copies of all documents must be provided.

SELECTION COMMITTEE

For each position, the selection committee is composed of five members appointed by the Minister, as follows:

  1. for positions at the Court of Québec: the chief judge of the Court of Québec or a judge designated by the chief judge from among the judges of the Court of Québec, who acts as chair of the committee;

    for positions at a municipal court: the associate chief judge of the Court of Québec who is responsible for municipal courts or a judge designated by the associate chief judge from among municipal court judges, who acts as chair of the committee;

  2. two persons designated by the Barreau du Québec; and

  3. two persons who are not judges or members of the Barreau du Québec or the Chambre des notaires du Québec, designated by the Office des professions du Québec.

SELECTION CRITERIA

To assess the application of a candidate, the committee considers the candidate’s competencies, including personal and intellectual qualities, integrity, knowledge and general experience, extent of knowledge of the law and experience in the areas of law in which the judicial duties will be performed, and capacity for judgment, insight, level-headedness, ability to set priorities and to render a decision within a reasonable time, and quality of expression, the candidate’s conception of the judicial office, the candidate’s motivation for the judicial office, the candidate’s human, professional, social and community experience, the candidate’s level of awareness with respect to social realities and recognition by the legal community of the candidate’s qualities and competencies.

DEADLINE: Applications must be received by February 24, 2012.
