Application for assistance with the Central Authority

A parent whose child has been wrongfully removed can obtain assistance from the Central Authority for Québec by submitting the following documents, depending on the situation:

  • the Request for the return of the child form duly completed and signed;
  • a copy of any decision or agreement homologated granting custody of the child OR a copy of the request for or a change of custody pending before the Superior Court or any court of competent jurisdiction before the removal or retention of the child with proof of service to the other parent (section 4 of the Act respecting the civil aspects of international and interprovincial child abduction);
  • a copy of the child's birth certificate;
  • a solemn declaration stating the circumstances of the removal or retention of a child, the steps that have since been taken to locate and bring the child back and, where applicable, any fact leading to the belief that the child’s safety and well-being are threatened;
  • a recent photograph of the child and of the other parent;
  • a copy of the warrant of arrest issued against the other parent, if any;
  • a list of the persons (parents, friends, others) or bodies likely to hold information regarding the whereabouts of the child;
  • a copy of the judicial proceedings related to custody instituted by the abducting parent in the State of refuge, where applicable;
  • a copy of airline tickets;
  • expert reports produced during custody proceedings;
  • obtain a letter from the Director of Youth Protection stating that no report has been filed for your child and a good conduct certificate from the police;
  • any other document produced by an organization (school, daycare, medical clinic, etc.) containing information that may support your request.

Child retained in Québec

In some cases, we can also intervene if a child who habitually resides in a State designated in the Act is retained in Québec. For more information, contact the Central Authority for your State.

  • the Request for assistance in organizing or securing the exercise of rights of access form duly completed and signed;
  • a copy of the judgment OR a copy of an homologated agreement between the parties OR a document stating the terms and conditions for exercising the proposed access and accommodation rights;
  • a detailed declaration summarizing the events that have occurred;
  • a photograph of the child and of the other parent;
  • a copy of the child's birth certificate;
  • any other pertinent document.

Child retained in Québec

We can also assist for the organization or protection of rights of access if your child resides in Québec. For more information, contact the Central Authority for your State.

The documents and forms must be written in French or English according to the State of destination. If necessary, they must be translated into any other language in accordance with the requirements set by the competent authorities of the State where the abducting parent is living.
