Request in Québec for the notification of documents from abroad
Requests for the notification in Québec of judicial or extrajudicial documents under the Hague Convention must be sent to the Central Authority for Québec. All requests must contain:
- the duly completed and signed form required by the Hague Convention, in duplicate, translated into French. For a notification, "(c) by delivery to the addressee" must be checked on the form; and
- the judicial or extrajudicial document to be notified, in duplicate, translated into French. See section translation for the requirements.
Processing of the request
- The Central Authority for Québec sends the form and one copy of the judicial or extrajudicial document to be notified by Canada Post's Xpresspost service to the addressee.
- The proof of receipt by the addressee and the Certificate, which is duly completed by the Central Authority are sent to the forwarding authority, together with the second copies of the documents.
If notification is unsuccessful, that is to say, if the recipient does not voluntarily accept the document, service of the document is suggested.
Where the address of a recipient is incorrect, the Central Authority for Québec is under no obligation to determine it since the Convention shall not apply where the address of the person to be served is not known.
