Rights and obligations of creditors
As the creditor in a voluntary deposit procedure, you must comply with the rules in force. You also have rights, and it is your responsibility to be aware of them and ensure they are respected.
For example, you are entitled:
- to obtain a list of all the registered creditors, on request, from the clerk;
- to contest the debtor’s declaration or the amount of a debt;
- to be kept informed of the debtor’s situation and any change in the situation;
- to receive your share of the amounts deposited by the debtor each quarter.
To find out more about the rules governing voluntary deposit, please see the subsection Legal aspects of voluntary deposit.
